The following guidelines help immigration officers to better protect and assist foreign nationals who become victims of trafficking in Canada. They are designed to help victims escape the influence of their traffickers and recover from their ordeal.
Temporary resident permit (TRP) and work permit for victims of human trafficking
Victims are eligible for a 180-day temporary resident permit (TRP).
Victims have the option to apply for a work permit.
There is no fee for the initial TRP or the initial work permit.
Depending on the circumstances of individual cases, TRPs can be renewed at the end of the 180-day period.
Health-care benefits and trauma counselling
Victims of trafficking are eligible for health-care benefits and trauma counselling under the Interim Federal Health Program.
In Canada, victims of trafficking are not required to testify against their trafficker to gain temporary or permanent resident status.
How do victims apply for the TRP and the work permit?
Immigration officers at local CIC offices interview potential victims to decide if they are eligible for the permit. If an immigration officer has reason to believe the person is a victim of trafficking, the officer can issue the TRP.
If the TRP is issued, the officers will help the victim make the first contact with the appropriate groups, including the embassy of their home country, provincial or municipal agencies, or non-governmental organizations that assist victims of trafficking. Immigration officers will also help the victim get access to health benefits, including counselling.
Individuals who receive the temporary permit can apply for a work permit at the same time. They will need to fill out the necessary paperwork and give it to the immigration officer for processing.
What are the benefits of the TRP program?
Victims of trafficking may require a short-term TRP for the following reasons:
To help them escape the influence of their traffickers.
To help them recover from physical or mental trauma (e.g., counselling or medical treatment may be necessary).
To provide a period of reflection so that they may have time to decide if they wish to return home OR assist in the investigation or prosecution of the traffickers.
In addition, a work permit allows victims to work in Canada while they consider their options.
